These Terms are governed by the laws of the jurisdiction where the user resides. For users located in India, these Terms are governed by and construed in accordance with the laws of India, and all disputes are subject to the courts in Kanpur, Uttar Pradesh.

For users located in the United States, these Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions, and any disputes shall be submitted to binding arbitration or small claims court in Bar Nunn or Natrona County, Wyoming, United States, as outlined in the Dispute Resolution section.

18Dispute Resolution

Any disputes shall be resolved via binding arbitration, as per applicable laws and regulations. By using the Platform, you agree to resolve disputes in this manner.

19U.S. Dispute Resolution (Binding Arbitration)

If you are a resident of the United States, you agree to resolve any disputes or claims relating in any way to your use of our Services through final and binding arbitration rather than in court. This includes claims based on breach of contract, tort, statute, fraud, misrepresentation, or any other legal theory.

The arbitration will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA’s Consumer Arbitration Rules. You and DigitalTreed agree to each bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. You agree to waive any right to a jury trial and any right to participate in a class action lawsuit or class arbitration.

20Export Control

You may not use, export, or re-export the Services in violation of any applicable U.S. export laws or regulations. By using the Platform, you represent and warrant that you are not located in a country subject to U.S. embargo or designated by the U.S. government as a “terrorist supporting” country.
